BabyDaze Terms of Use

These Terms are an agreement between you and Carmy Labs Inc., the owner and operator of BabyDaze ("Carmy Labs", "we", "us"). By creating an account or using the BabyDaze app you agree to them. If you do not agree, do not use the app. Apple's Standard End User License Agreement also applies to the app; if these Terms conflict with that agreement, the Apple agreement controls for the licensed app.
1. What BabyDaze is
BabyDaze is a private video journal. A parent creates a journal for a child, and invites family and friends to record clips into it or to watch. Journal access follows the circle and audience the parents and poster choose. A parent can also deliberately share selected moments outside the circle through an expiring external link or a separately exported video file.
2. Your account
- You sign in with Apple. Keep your Apple Account and device secure; you are responsible for activity under your account.
- You must be at least 18 to create an account, or the age of majority where you live. Children appear in journals as subjects; they do not hold accounts.
- Before completing account setup, you must affirm that you are an adult account holder.
- One person, one account. Do not share access to your account.
3. Parents own the journal
The parents of a journal control it. They decide who joins, what role each person has (parent, recorder, watcher), whether recorders' clips need approval, and they can remove people, clips, or the whole journal at any time. If you are invited to a journal, your access exists at the parents' discretion and can end without notice.
4. Your content
- You keep ownership of clips, photos, captions, and comments you post. You give us a licence to store, process, and deliver them to the people you and the parents have chosen, which is what the service does. That licence ends when the content is deleted.
- Only post content you have the right to post and that the child's parents would want in the journal.
- Posting a clip into someone else's journal means the parents can keep it, share it within the circle or deliberately outside the app, edit its caption, or delete it. If you leave, your clips stay unless a parent removes them.
- An external sharing link lets anyone who receives it watch the selected ready moments without an account, including when the journal audience is restricted. The shared player shows each clip’s capture time and the recorder’s profile display name. It expires after seven days and the creating parent can turn it off. Later uploads are not added to that link. Turning a link off cannot remove copies a recipient already obtained.
- When you choose Share video file, or Save to Photos or Share video for an optional covered-video export, the exported file is provided to Photos or the sharing destination you select, which may have its own terms and privacy practices. You are responsible for any sharing outside the circle. We ask that you not screen-record or screenshot clips. Parents may be told when a screenshot is taken.
5. What you may not do
Do not use BabyDaze to post anything unlawful, abusive, sexual, or that exploits a child; harass anyone in a circle; impersonate another person; violate privacy, publicity, copyright, or other rights; try to reach journals you were not admitted to; probe, disrupt, or overload the service; introduce malicious code; evade access controls; or reverse engineer the app except where the law expressly permits it. We may remove content or accounts that break these rules, and we report apparent child sexual abuse material to the appropriate authorities when required by law.
6. Reporting and blocking
Any member can report a clip or comment. Parents of that journal receive the report and can remove the reported item. Carmy Labs may review reports, preserve relevant records, remove content, restrict features, suspend access, or contact authorities when reasonably necessary to enforce these Terms, protect a child or another person, comply with law, or protect the service. For a safety concern that needs escalation beyond the journal, contact us through https://babydaze.xyz/support. You can block a person, which removes them from journals you parent and stops future invites from them.
7. Notifications and messages
Push notifications are optional and controlled in Settings.
8. Ending your account
You can delete your account in Settings. Journals where you are the only parent are deleted with every clip. Journals you share with another parent stay with them. Your clips, comments, and profile are deleted from every journal, and your Apple sign-in access is revoked. Deletion is permanent in the live service. Residual copies may remain in encrypted service backups for up to 30 days before being overwritten through the providers' normal backup cycle, unless a longer period is legally required.
9. Suspension and termination
You may stop using BabyDaze and delete your account at any time. We may suspend or terminate access, remove content, or preserve evidence when we reasonably believe these Terms were violated, a person or the service is at risk, or the law requires it. Where appropriate, we will provide notice and an opportunity to address the issue. Terms that by their nature should continue—including ownership, disclaimers, liability limits, and general contract terms—survive termination.
10. Third-party services
BabyDaze relies on Apple and other service providers described in the Privacy Policy. Their services may have separate terms. When you deliberately export content to Photos or another destination through the iOS share sheet, your use of that destination is governed by its terms and privacy practices. We are not responsible for a destination you select or for conduct by other members of a journal.
11. Availability and changes
We work to keep BabyDaze available and to back up your journals, but we do not promise uninterrupted service. We may change or discontinue features. If we discontinue the service we will give you a reasonable chance to download your journals first.
12. Disclaimer and liability
BabyDaze is provided "as is". To the extent the law allows, we disclaim warranties and are not liable for indirect or consequential losses. Nothing here limits liability that cannot be limited by law.
13. Changes to these Terms
We will tell you in the app before material changes take effect. Continuing to use BabyDaze after that means you accept them.
14. General terms
These Terms and the Privacy Policy are the entire agreement between you and Carmy Labs about BabyDaze, in addition to Apple's applicable terms. If a provision is unenforceable, the remaining provisions continue in effect. A failure to enforce a provision is not a waiver. You may not transfer these Terms without our consent; we may transfer them as part of a merger, financing, reorganization, or sale of the service, subject to applicable law and the Privacy Policy. These Terms are governed by the laws that apply where Carmy Labs is established, without overriding mandatory consumer protections that apply where you live.
